The Decree Principles Land Policy (Decreet Beginselen Grondbeleid) (the ‘Decree’) codifies the general principles regarding State-owned land. The Decree stipulates that all land, with respect to which no party has the title deed, is owned by the State. With respect to land allocated before 1 July 1982 additional legislation applies. With respect to spatial planning reference is also to be made to the Decree allocation of State-owned Land (Decreet uitgifte Domeingrond) in which the (legal) persons are described that are eligible for the acquisition of State-owned land.
