Trade names
Although Aruba does not have specific trade name legislation, the holder of a trade name may, according to the current interpretation of the law, claim protection of his trade name based on the Aruba Trademark Ordinance 1989, if the trade name is registered, or based on general tort law. The protection is based on the general principles of tort law. The owner of an older trade name can oppose the use of a similar trade name that is confusing to the public, in particular given the services offered and the locations of the businesses exploited under the respective trade names.
