Data protection & privacy

There are no specific laws on the protection of databases or data in general in Curaçao. However, the protection of personal data is provided for in the Personal Data Protection Ordinance (in Dutch: Landsverordening Bescherming Persoonsgegevens). Anyone who collects, retains, uses or otherwise processes personal information is only allowed to do so, if either the person concerned has granted his/her clear permission for processing the information, or where processing the information is necessary (i) for the performance of an agreement with the person concerned, (ii) due to a statutory obligation, (iii) to warrant a vital interest of the person concerned, (iv) in relation to public duty, or (v) in connection with a legitimate interest of the processing party unless the interests or fundamental (privacy) rights of the person concerned prevail.
